Judicial War Part I
First, let me start by stating very clearly that despite the rumors to the contrary, Chief Justice has not announced his retirement, yet. It is a distinct possibility that he may. However, Bill Kristol—columnist extraordinaire at the Weekly Standard—believes it will not be Rehnquist that steps down, but rather Justice O’Connor will. It is a serious possibility either way. And amidst these rumors are that Pres. Bush will nominate Attorney General Alberto Gonzales to the vacancy.
Big mistake.
Gonzales is not as conservative as everyone believes he is. He is a moderate, and one that can be virtually depended on to be "moderate". His stance on issues is irrelevant to the general public; they bear no jurisprudential merit. But his ideas regarding judges, as a whole, is what concerns me. He is not one to criticize an activist judge.
Further, it would be unwise of Pres. Bush to cave to the obstructionist Democrats, and the Gang of Fourteen, in the Senate by appointing an "easier" nominee.
Mr. President, appeasement, as you know, is not a wise choice. An enemy will only be further emboldened.
Look at the hell within the Senate, and tell me I am wrong. We have the Senate GOP scared of their own shadows, and Senate Democrats that are the boogeyman within the shadows. The GOP is beyond reluctant to engage the Democrats. At every turn, they seem to be thwarted. Not just by members of their own party, but by their own ineptitude.
Now is not the time to act like this. The war for the courts is about to get hotter regardless of the justice that steps down, and now is not a time to cave; the future of the high court is at stake.
We need originalists on the courts; ones that respects the law, and it’s inherent "black and white" nature. Activists, I am sorry, are not welcome on the courts of this nation. Their reign of terror should be squelched as much as possible. They do not rule on the law; they rule on politics of the time and personal preferences.
