I’m Not God: Even I Can Be Wrong

Leave it to my half-assed source who can’t even keep his info straight for a lousy 24 hours. Yes, I’m referring to the post Marcie put up last night, on what I told her, where it was confirmed Rehnquist would be the first to go. This morning O’Connor announced her retirement from the Court first. Wonderful. Memo to self: Don’t trust that SOB again. I’ll run on my own analysis from now on.

Now comes the fight. It’s going to get nasty. There’s going to be a lot of mud thrown from either side—both behind closed doors in Committee, and in public. Stay the course, folks. We’ll get them confirmed. (Needless to say, because Rehnquist didn’t step down first, all bets between Marcie and I are off.) Luttig and Roberts will be the first nominees brought forth from the White House. McConnell may follow them to be seated in O’Connor’s vacancy. McConnell is a moderate in the mold of O’Connor, but just a bit more conservative than the 75 year old O’Connor.

We’re also hearing Gonzales bandied about. I have reservations about Gonzales, as he is a moderate more in the mold of Justice Kennedy or Souter (Moderates? Yeah, right), but I still don’t want Gonzales up there. He is too moderate for the High Court. But, Gonzales is not the right person for the Court. If Bush nominates him, then I withdraw support from the president regarding his domestic agenda. If the Senate approves Gonzales, then I stand with Captain Ed Morrissey in holding true to the concept of "not one more dime" to the NRSC. CALL YOUR SENATORS, AND MAKE YOUR VOICES HEARD!

I think that Judge Janice Rogers Brown and Judge Priscilla Owens would be ideal to add to the High Court. The problem with both is they are newly confirmed, and barely in their positions now. To uproot them again, and force them through more confirmation hearings could be construed as "cruel and inhumane" punishment. The flip side to the argument is that both are included in the deal, and the Democrats can’t filibuster them. But that isn’t a reason to appoint them.

I hear from people, like Limbaugh, that a woman would be, and should be, the ideal replacement. No. I’m sorry, but as usual, I disagree with Limbaugh. The best qualified person should be appointed to the Court. The appointment to the Supreme Court should have nothing to do with gender or race. It is the qualifications that matter to me, which is why I stand against judges like McConnell, and a person like Gonzales.

Mr. President, drop the loyalty to this man. He’s your attorney general. Drop the issue. You’re appointing people to the Court that will set the standard for years to come. Don’t play the moderation game, and choose the lesser of two evils. And if we all thought Gonzales was savaged in his hearings for attorney general, what sort of hell is going to be rained on him if appointed to the High Court?
No. The best qualified appointee should be nominated. That’s Luttig. That’s Roberts. That’s Kavanaugh, and possibly even Saad. But it’s not Gonzales and it’s not McConnell.

You say no Gonzales (I agree), and no McConnell (nor argument from me there either), but you want Mukasey? Mukasey's a moderate that is another nominee the Left-side of the blogosphere is touting. Are you nuts?

Thanks to Mukasey's hare-brained decision in the Padilla case, it gave precedent for the Hamdi v. Rumsfeld case.

No, I'm sorry, no Mukasey either. Do more research, and I'm sure you'll agree.
