From Italian Idiots to American Idiots…
No, we’re not giving up on the Sgrena Report. Marcie did a good job posting up the updates that she found this morning, and it seems as though the blogroll that is picking this up and looking at it is growing. But I’d like to take the opportunity to go back and address another subject today—one in which this weekend’s news about the Sgrena report gave us a welcome respite from it.
I am, of course, referring to the Constitutional Option in the Senate.
I took a look at the offer that Frist made to the Democrats last week, and whereas I’m apprehensive about any sort of compromise (short of ramming the option down the Democrat’s throats), it isn’t a bad offer. The Republicans would allow 100 hours of debate over the nominees on the floor of the Senate, but there would be no filibuster over those nominees. But what is most reprehensible in my eyes is the attempted character assassination of certain judicial nominees.
Namely, Janice Rogers Brown.

JW: The second point to be made here is, Bill, If they had a real debate about people like Priscilla Owen and Janice Rogers brown, the American people would say these folks are too extreme. Even republicans have said that in the case of Priscilla Owen and her rulings in Texas –
BK: Which Republican was that?
JW: In fact, a majority of –
BK: Wrong, wrong, dead wrong. His testimony, his recent testimony on the hill –
JW: He said he didn't mean what he written but he wrote that she was an activist judge which is exactly what Republicans are complaining about, that these judges have become activists legislating from the bench. If you listen to Janice Rogers attitude about people with disabilities, affirmative action, if you go on and on, she –
BK: That doesn't say anything about people with disabilities. When has she ever written about people with disabilities? She was reelected by the people of California with 75% of the vote. She's highly rated by the A.B.A. And people are saying –
JW: This is a debate that we should have.
BK: Absolutely. The republicans want to have it. They offered 100 hours of debate on the floor of the senate on each of these nominees If the democrats would guarantee an up-or-down vote. The republicans to want debate these nominees.
Janice Rogers Brown is more than qualified to hold a seat on the federal bench. She is a sound jurist with originalist leanings. That is what scares the Democrats. Each of the hotly contested nominees are originalists. The Democrats can’t keep pushing an agenda through the courts if there are going to be judges on the bench that find no merit in their cases. Many of the egregious decisions that the judiciary has made (Roe v. Wade, Lawrence v. Texas, Hamdi v. Rumsfeld, etc.) has been without any merit.
So, each and every nominee the Democrats disagree with, among these ten awaiting their vote, are going to be labeled "extreme". They can’t provide the proof that these people are extreme, nor can they point to the ABA; the ABA has given high marks to each of them. As Kristol points out, Janice Rogers Brown has high marks from the ABA, and was voted back into office by 75% of the people in California voting. Hardly the "extreme" jurist that Williams and the Democrats keep painting her as. Especially in the "People’s Republic of California", which is anything but a place of originalist thought.
Let’s face it, the Democrats are digging in, and RadioBlogger has a link up to Frist’s comments as to how much longer we will have to wait. Frist promises no longer than three weeks. Though, I have no idea why he would be willing to wait on this. Frist, Santorum, and McConnell have all stated that the GOP has the votes to break the filibuster, should they be executed. So, why wait the extra couple of weeks? Do it first thing Monday morning that the Senate is back in session after this week’s recess. This issue is too important to allow the MSM and the Democrats to ramp up the scurrilous attacks on the nominees, or the GOP.
