Chief Justice Roberts Has A Nice Ring To It

That is correct. Judge John Roberts has been elevated to replace his longtime friend and mentor, William H. Rehnquist, who passed away on Saturday. The move is a smart pick, as Pres. Bush had wanted Roberts for the Chief Justice position to begin with. But, O’Connor stepped down first. Now that Rehnquist has passed on, it only made sense for Bush to do this, lest he leave the vacancy open for the senior justice on the Court. The Supreme Court cannot begin its next session minus a Chief Justice, and Bush realized this.

This, however, clears the way for another nominee. Bush will be replacing a conservative with a conservative, in the announcement of Roberts to the Chief Justice position rather than an Associate Justice position. It also makes sense because to elevate a sitting justice, say Justice Scalia, it would create a firestorm in the Senate. So, the question remains, who will he name to the O’Connor vacancy?

The list is long and plentiful. In June and July, the president revealed he did have a short list, and all of them are strong conservatives. The list included: Miguel Estrada, Edith Clements, Priscilla Owens, Janice Rogers Brown, Emilio Garza, and J. Michael Luttig. Anyone of these people could be appointed. But who will he choose?

At the Asylum, we have been debating this point since Roberts’ initial nomination. As far as we are concerned, his next nominee should be J. Michael Luttig from the 4th Circuit Court. Miguel Estrada should be number two on his list, followed by Janice Rogers Brown. Those are my three. Thomas would prefer that Estrada be dropped, as he withdrew his nomination, and instead have Emilio Garza brought up. Of course, Estrada withdrew his nomination because he was sick of waiting for his proper up-and-down vote, not because he was being attacked by the Left.

Luttig is our number one pick. This is not based on ideology, unless you consider our knowledge and devotion to the law and the judiciary an ideology. We believe in the rule of law, and that laws mean what they say. There is no gray area within the law for playing around. Any gray areas should be addressed by the appropriate legislative body. Luttig, as Thomas posted yesterday, is against the role judges have made for themselves in the activist mold. He chastises conservative and liberal jurists, alike, for their activism. In his opinion, judges should abide by the written law, not the made-up law.

That is not to say the man will not abide by precedent set by past decisions. He will. He has no choice. Like us, I am sure he despises the decision in Roe, and in other decisions that are figured incorrectly. However, we—Thomas and I—have no choice in accepting the law as it is interpreted. Roe stinks, but it is set precedent. WE do not get to pick and choose what laws we will follow and those we will not.

The other thing that should be taken into account is that the president, in an effort to have a full court in session as of October 1st, may choose to recess appoint a judge to the high court. Many people will urge him not to make this move, but we at the Asylum encourage him to look into the move seriously. O’Connor has given her notice of retirement. She should not be held over.
But the Left is not playing by the rules. (What else is new; these people have not seen a rule that they are not willing to break.) Sen. Schumer wants time to mourn the passing of Rehnquist. He called Rehnquist a "towering figure" in the judiciary. And yes, I am sure that Schumer joined Sen. Kennedy later for a drink to wash that bad taste out of his mouth after heaping praise on an ideological enemy. Sen. Dodd is considering asking the president to rescind O’Connor’s retirement so he has more time to consider a proper replacement for Rehnquist. (I guess Sen. Dodd missed the fact that the president has a replacement chosen. Now, he is back to looking for someone to replace O’Connor.) And it has been further stated this morning that Roberts’ confirmation hearings should begin on Thursday.

The Left is about to be pummeled by the 800 pound gorilla in the room. The gorilla will be played by several figures, including Roberts, the president, and the bloggers. Bloggers made an unprecedented move just a couple short weeks ago when 88 bloggers vetted Roberts themselves. They went through the documents that were released by the Reagan library, and thoroughly disseminated them. In our estimation, Roberts is a great pick, with no skeletons, and a legal mind that is matched by the best minds on the high court. If the president adds Luttig to the court, the Left will be in the same death throes the terrorists in Iraq are.

The announcement of Luttig, or any justice equal to him, will begin World War Five, and the first detonation will be in the Capitol when the Left blows it’s collective stack. Thomas pointed out earlier this morning that this is the beginning of the end of the hold they have had on the judiciary. People are fed up watching unelected, lifetime-appointed judges tearing apart their way of life, and shredding the Constitution. The last straw for the country was Kelo, which virtually stripped the people of this nation of one of their most important rights. That being the right to own private property, free and clear of government seizure without just compensation.

The Left has missed the warning signs over the last few years. Now, those signs are about to be rammed right down their throats.
