The Asinine "Circus" In All Three Rings.
LOL. I love that title that Thomas and Marcie bestowed on the Ninth Circuit Court of Appeals. Yes, as a lawyer, I've heard that name before, and as I have never tried a case there, I give it less than little attention. However, I came across this news story on the radio on the way home, and it really ticked me off. I'm 44 years old, and I'm single. I've never had a kid, and honestly now it's a bit late in my life to consider such a thing. However, if I were a parent, especially one living in California, I'd be incensed at the court for it's sheer arrogance in the decision of this case. The case is Fields v. Palmdale School District, and below is a link to their decision.

Yesterday the Ninth Circuit Court of Appeals ruled that, “[T]here is no fundamental right of parents to be the exclusive provider of information regarding sexual matters to their children, either independent of their right to direct the upbringing and education of their children or encompassed by it. We also hold that parents have no due process or privacy right to override the determinations of public schools as to the information to which their children will be exposed while enrolled as students.”
According to Pro-Family Law Center’s President, Richard D. Ackerman, “This the most disturbing holding I have seen in my legal career. While I thought that the Ninth Circuit had certainly outdone itself with the Pledge of Allegiance decision, this is beyond anything they have done before. Most people do not realize that this decision absolutely guts all family rights. Once we conclude that the government’s interests in the morality of families are absolutely superior to those of parents, we have moved the last step toward totalitarian rule.”
Ackerman goes on to say, “What this clearly means is that we must also make important decisions about who sits on our local school boards, local courts, and in other local positions of trust. The bottom line is that the school board in the Fields v. Palmdale School District case decided to instruct the district’s attorneys to destroy the parents who complained about their 7-year-olds being asked questions about things such as, ‘[t]hinking about touching other people’s private parts.’ These board members ought to be recalled immediately.”
For me to say that this ruling is idiotic is an understatement. In essence, what this ruling does is allow schools to tell parents to, in effect, "butt out." The schools now have the power to dictate to parents what their kids will and won't be taught. This is just dealing with sex. Now, I know a lot of people roll their eyes about the topic, but let's face it, parents haven't exactly been forthright with their kids on the subject. Some have been a little too forthcoming, hence the our babies having babies. But, this is a subject that many parents aren't entirely comfortable talking to their kids about this.
However, it doesn't belong in the schools. For a long time, the schools--the liberal-run (for the most part) institutions of indoctrination--have been pushing this envelope. First, it started out as just sex education, but it has grown from there. We have across the country classes in schools--even elementary schools--that teach concepts like "creative masturbation," "foreplay," and a high school was even teaching boys and girls about oral sex. Honestly, this is disgusting. Look, I'm pretty flirtatious, and I can joke with the guys after work over drinks, but there's just something wrong when the schools think that they can teach our kids ANYTHING they damn well feel like teaching.
This case is just one of many reasons why many parents are going the home-school route, attempt charter schools, or take an extra job to afford a private school. The teachers, and those who think they know what is best for our children, dislike these ideas, and have launched a war against them. In Illinois, the school districts got together with the NEA, and attempted to force a curriculum on several prominent charter schools. The measure failed--miserably--in court. The charters still have the ability to teach kids the way they feel is correct, which is a much different approach than the public schools have taken.
This is another example of a group of "educators," and yes I use the word loosely, trying to force an agenda on an unsuspecting, unaware student populace, and proudly patting themselves on the back for another job well done. But it isn't, and these educators should be ashamed of themselves. And what is truly sad is that the people in charge of the education of our children--what they will learn and what they won't, and I'm referring to the big-wigs in DC--is none of these people have a teching degree. They're all psychology degrees. NOTHING in their resume shows they have the qualifications to be setting any sort of curriculum for our children.
When I heard this story, I got angry. When I got home and started reading about the case, and the court's decision (linked above) I blew my top. If this were my child being told that he had to learn about all levels of sex, from a complete stranger, at the age of ten...I'm not entirely sure how I might react as a parent. I can only guarantee one thing about my reaction. It would be the last time my child EVER went to a public school.

Outrageous! One item on the ACLU's policies agenda is no restraint for children and sex. I read this decision as being on the road to destroying parent's rights and responsibility and the family. In my definition of socialism, the state ( read school boards) control what we the people are to think and refrain from thinking. Sex doesn't belong in the class room. Rawriter.
